How To Bring Up A Point In Court?
I will be defending a pacing ticket that my wife got a few months back. I have requested and received an (incomplete... I'll deal with that later) disclosure. Nowhere in the the disclosure does the officer indicate that he made any check of his vehicles speedometer. (No verification before or after by any method at all.)
So, what do I do in court? Do I cross examine and ask why he didn't check it? What if he says he did, but forgot to put it in the disclosure?
Do I wait until he is done, then call "no questions" and then talk about it? I am not sure how to handle it. I don't want to give the officer an opportunity to correct his omission.
