86 In A 60 Zone, Court On Wednesday, Requested Disclosure

Unread post by jbody »

So my court date is on wednesday and i already requested the disclosure.

but due to the fact its a speed trap, there aren't really any notes.

LTI Marksman 20-20 (megatech) was used.

test results:

on self test, scope alignment, fixed distance/0 vel, display test.

these were checked off in the boxes.

test was completed on a cement wall 10m or 10inches and something about chalked.

they were sitting behind an overpass with a slight curved road. it was a 3 officer speed trap with only one speed measuring device used.

and the only notes that the officer that pulled me over on her list of people pulled over under notes is:

can't read the first word but it than says "L1 closing in quick behind 2 lead cars"

documentation also lists the time, speed, metres 200.2, which lane (l1), number of occupants

i also requested additional disclosure of the other officer's note and i got a reply from the crown denying my additional disclosure from the other officers as the correspondace states that they are not relying on the evidence of the other officers who may have been present at the time.

the officer's road alignment picture depicts the actual road alignment pretty obscured as the road is straight after the underpass but it curves to left from the officer's operating view.

any help is appriciated. court is in kitchener

If LEO1 tagged you with a lidar, LEO2 flagged you down, and LEO3 wrote you a ticket, then all of them should be there and present. There is more to that. Is manual to the lidar provided? etc...

There is more to that... Did every police officer test the device? Was it the same cop that pulled you over manning the lidar at the time you were clocked? To ask proper questions I have to re-read the original thread. They are all there.

I requested additional disclosure from the other cops that were there, but the crown denied my request stating in the correspondence that they are not relying on the other officer's or if there were other officers involved. And I don't know who was manning the lidar as I only saw her come out to flag me. You're kind of coming around a bend

no times stated for any test, just has a start up test and a post test. and the times of the vehicles that were pulled over.

i can perhaps scan the document if its easier.

so i got convicted at 86 in a 60.

even though i was denied disclosure of the other officers that were involved, the officer stated on oath that the other officer was her superior and the officer has been in the trafficking platoon for well over 20 years.
